Resolution of Business-Threatening Lawsuits

In a business dispute or commercial litigation, our attorneys can help you recognize your options in negotiating a settlement or going to trial.

Business litigation is, at the very least, a significant distraction from running your business and maximizing profits; at its worst, it can threaten the very existence of your company.

You can count on Shorall McGoldrick Brinkmann's skill in litigation and trial work in resolving shareholder disagreements; disputes with a supplier, customer or competitor; a party with which you have entered into a contract; a current or former employee; or any other parties with which your company has a legal conflict.

We have represented clients in cases involving fraudulent real estate conveyances, breach of contract actions, and collections actions on large volume debentures. We are experienced with the nuances of cross-border litigation and have litigated complex cases involving out-of-state and foreign parties.

Results

Some of the law firm’s major accomplishments in business-related litigation include the following successful outcomes:

  • Won a $695,000 jury verdict, upheld on appeal, for damage to a massive power transformer caused by a defectively designed and manufactured heavy-haul trailer

  • Obtained a directed verdict, in a high six-figure claim, on behalf of the private sellers of a Sedona-area home for allegedly undisclosed mold

  • Obtained a $526,000 jury verdict for common-law indemnity against a material supplier of defective sand used to form stucco walls; believed to be one of the only such trial verdicts in Arizona history

  • Obtained a defense verdict for a defendant homeowner alleged to have violated the CC&Rs of their homeowners association

  • Obtained a six-figure settlement from the architect and builder of a Grand Canyon-area hotel for defective design and construction

SMB Legal Notes

Enforcing Out-of-State Judgments in Arizona (2010): A judgment issued by a court outside of Arizona is a “foreign” judgment under Arizona law. Such judgments may be domesticated in Arizona courts under the Uniform Enforcement of Foreign Judgments Act.
